New York law limits what a notary public may do. A notary may perform authorized notarial acts, but a notary who is not acting as your licensed attorney may not give legal advice, choose legal forms for you, draft legal rights, or tell you what a document means.

Under New York Executive Law § 135, a notary public is authorized to perform notarial acts such as administering oaths and affirmations, taking affidavits and depositions, and certifying acknowledgments or proofs of certain written instruments. That authority is not the same as being licensed to practice law.
New York Executive Law § 135-b also requires a notary who advertises in a language other than English to post this notice in that language: “I am not an attorney licensed to practice law and may not give legal advice about immigration or any other legal matter or accept fees for legal advice.”
New York Judiciary Law § 478 also restricts non-attorneys from holding themselves out as attorneys or furnishing legal services. This is why we keep our role clear and limited.
What we can do
- Verify identity and willingness for eligible notarizations.
- Administer an oath or affirmation when legally appropriate.
- Take an acknowledgment or jurat when the document is complete and the signer is ready.
- Provide general information about our scheduling, ID requirements, fees, and notary process.
- Help coordinate apostille-related processing steps for eligible documents.
What we cannot do
- Tell you which legal document you need.
- Explain your legal rights, obligations, risks, or consequences.
- Draft, revise, or customize legal language for your specific situation.
- Tell you whether you should sign a power of attorney, deed, contract, affidavit, waiver, settlement, immigration form, or court paper.
- Review a document for legality, enforceability, sufficiency, or whether it protects your interests.
- Accept payment for legal advice or act as your attorney.
