Apostille Terms of Service

These terms apply to apostille quote requests, next business day service, and no-rush mail processing offered by Notary Ninjas, LLC. Shipping fees are billed separately from apostille service fees.

Service Options

  • Next business day service means expedited internal handling after review and acceptance of your order. It does not mean the New York Department of State, County Clerk, mail carrier, or any third party will complete work within one day.
  • No-rush mail processing is a lower-cost service handled in the normal order received. Processing times vary by document type, county requirements, state workload, and shipping conditions.

Important Terms

  • No refunds. Once review, handling, preparation, filing coordination, or processing begins, fees paid are non-refundable.
  • We do not correct your records and we are not responsible for mistakes, omissions, expired records, name issues, document defects, translation issues, or rejection caused by the contents of the documents you provide. We process what you submit.
  • We do not provide legal advice. We do not advise you on whether a document should be used, whether a foreign authority will accept it, or whether legalization, translation, or additional certifications are required.
  • Not every country accepts an apostille. Countries outside the Hague Apostille Convention may require embassy or consular legalization instead. You are responsible for confirming the receiving country's current requirements.
  • We do not control the mail or courier carriers. We may offer FedEx, UPS, or USPS tracking options, but tracking shows shipment activity only. Shipping fees are separate, and delivery timing, weather delays, routing issues, customs issues, and lost packages remain outside our control.

Document Review and Originals

  • Some documents must be original certified records issued by the proper authority. Other documents may first need notarization, County Clerk certification, or both before they can be sent for New York apostille processing.
  • If original documents are required, you must mail the correct originals exactly as instructed. We are not responsible for delays caused by incomplete submissions, the wrong issuing authority, or damage in transit.

Document-Specific Requirements

  • Federal documents are not apostilled or authenticated by the New York Department of State. If your paperwork is federal, it must go through the proper federal channel, not the New York State apostille process.
  • Division of Criminal Justice Services background checks generally need a separate verification letter signed by the Commissioner or an authorized designee confirming the fingerprint results before New York apostille processing can move forward.
  • New York State Department of Health birth, death, and marriage certificates signed by the Director of Vital Statistics may usually be submitted through the New York State apostille route. New York City Department of Health vital records need additional New York County Clerk handling, and NYC birth and death certificates also require a Letter of Exemplification before County Clerk submission.
  • Birth, death, and marriage certificates issued by a city, town, or village clerk generally need certification from the County Clerk in the county where the document was issued before state apostille processing.
  • Educational records typically must first be certified by an authorized school official stating that the document is an official record or true copy. That school official's signature must then be notarized, and the notary signature must then be certified by the County Clerk where the notary is qualified.
  • Other documents, including many powers of attorney and similar private records, usually must be notarized first, and the notary signature must then be certified by the County Clerk in the county where the notary is qualified before submission for apostille.
  • County practices can vary. You may need to contact the relevant County Clerk for local certification requirements before an apostille request can be completed.
